Terms of Service

This is a reference translation of the Japanese original. If there is any discrepancy between this translation and the Japanese version, the Japanese version prevails.

These Terms of Service (the “Terms”) govern the use of the application and related services “Toravia” (the “Service”) provided by the Toravia Operations Office (the “Operator”). Users shall use the Service on the condition that they agree to these Terms.

Article 1 (The Service)

  1. The Service provides text translation, back-translation, nuance checking, AI-assisted features such as summarizing, refining and rephrasing, and the saving and syncing of history and settings.
  2. The available features, translation engines, supported languages, character limits, credits and other conditions may vary depending on the plan, purchase status, device, region or the time of provision.
  3. The Operator may change the content of the Service as necessary to improve quality, perform maintenance, comply with laws or for other legitimate reasons.

Article 2 (Accounts)

  1. Users shall register an account using accurate and up-to-date information and shall manage their credentials at their own responsibility.
  2. Accounts may not be transferred, lent or shared with third parties.
  3. Minors must obtain the consent of a legal guardian before using the Service.
  4. Users may delete their account from the settings within the app. Upon deletion, usage data held on the servers and any remaining credits will in principle be erased and cannot be restored.

Article 3 (Submitted Content and External Processing)

  1. Users shall confirm that they hold the necessary rights or lawful authority over any text or other data they enter or transmit for translation or AI processing.
  2. The Service may transmit submitted content to Google, Microsoft, DeepL and other external processors to the extent necessary to provide its features.
  3. When entering confidential information, personal data, trade secrets or other information that should not be transmitted to third parties, users shall carefully confirm both the necessity of and their authority for such transmission.
  4. Submitted content and data saved by users are handled in accordance with the Privacy Policy.

Article 4 (Translation and AI-Generated Results)

  1. Translations, quality assessments and AI-generated results are not warranted to be accurate, complete, fit for any particular purpose, original, or free from infringement of third-party rights.
  2. When used for medical, legal, financial, safety-related or other important decisions, users shall carry out appropriate verification, including review by qualified professionals.
  3. Users bear final judgment and responsibility for adopting, publishing, transmitting or otherwise using generated results.

Article 5 (Fees, Subscriptions and Credits)

  1. The prices, terms, free trials, granted amounts and other conditions of paid plans and credits are as displayed on the purchase screen.
  2. Subscriptions renew automatically in accordance with the conditions displayed at the time of purchase. To stop renewal, cancel from your Apple App Store or Google Play account settings before the next renewal date.
  3. Payment, cancellation, refunds and the restoration of purchases are subject to the terms and procedures of the store used. Except where required by law, the Operator does not issue refunds directly outside the store.
  4. Monthly credits are refreshed each designated period. Purchased credits currently have no expiration date and carry over to the following months, but the Operator may change this treatment with prior notice where required by law or for operational reasons.
  5. Credits lost due to account deletion, suspension for breach of these Terms or other causes attributable to the user cannot be exchanged for cash, transferred, restored or refunded, except where required by law.

Article 6 (Invitation Program)

  1. The Operator may offer an invitation program and grant credits or other benefits to users who meet the prescribed conditions. The content, applicable conditions and grant limits are displayed in the app or by other means determined by the Operator.
  2. Credits and other benefits granted through the invitation program cannot be exchanged for cash, transferred to another account, or sold.
  3. If there is false registration, abuse of multiple accounts, self-invitation, improper acquisition or distribution of invitation codes, or any other conduct the Operator reasonably deems fraudulent, the Operator may revoke granted benefits, reclaim credits or restrict use of the Service.
  4. The Operator may change, suspend or terminate the invitation program without prior notice as required for operational, technical or other reasons.

Article 7 (Prohibited Conduct)

Users shall not engage in any of the following when using the Service.

  • Conduct that violates laws, public order and morals, or the rights of third parties
  • Creating or distributing content that is illegal, harmful, discriminatory, deceptive or infringing
  • Placing an excessive load on the Service or on external services
  • Attempting unauthorized access, reverse engineering, or the exploitation or circumvention of vulnerabilities
  • Impersonating others, misusing accounts, or misusing payment methods
  • Interfering with the operation of the Service, or conduct the Operator reasonably deems inappropriate

Article 8 (Intellectual Property Rights)

  1. The software, design, text, trademarks and other rights constituting the Service belong to the Operator or to the respective rightful owners.
  2. Rights to content submitted to the Service by users are retained by the users or the respective rightful owners. Users grant the Operator the authority to process such content to the extent necessary to provide, maintain and improve the Service.

Article 9 (Suspension of Use and Interruption of the Service)

  1. The Operator may restrict or suspend use without prior notice in the event of a breach of these Terms, fraudulent use, security requirements or other reasonable grounds.
  2. The Operator may interrupt all or part of the Service due to maintenance, failures, disasters, suspension of telecommunications carriers or external services, or other unavoidable circumstances.

Article 10 (Disclaimers and Limitation of Liability)

  1. The Operator does not warrant that the Service will be available at all times, will be free from errors, or will be fit for any particular purpose.
  2. Where a user suffers damage due to causes attributable to the Operator, the Operator's liability shall be limited to the amount the user paid to the Service during the twelve months preceding the month in which the damage occurred, except in cases of the Operator's willful misconduct or gross negligence, or where such limitation is not permitted by law.
  3. Where all or part of this Article does not apply due to the Consumer Contract Act or other mandatory law, such law prevails to that extent.

Article 11 (Changes to These Terms)

The Operator may amend these Terms where required by changes in law, changes to the Service or other necessity. Changes that materially affect users' rights or obligations will be announced in advance through in-app notices, this site or other appropriate means.

Article 12 (Governing Law and Jurisdiction)

These Terms are governed by the laws of Japan. In the event of a dispute concerning the Service, the Japanese court having jurisdiction over the location of the Operator shall be the exclusive court of first instance by agreement, to the extent permitted by law.

Article 13 (Language of These Terms)

The Japanese version of these Terms is the authentic text. The Operator may provide translations into other languages for reference, but in the event of any discrepancy between the Japanese version and a translation, the Japanese version prevails. This does not apply where mandatory law in the user's country of residence requires the language of that region to prevail.
